A three-judge panel rebuked lawyers for Apple(s aapl) and the federal government on Tuesday morning, as the two sides argued over what to do about a court-appointed monitor that Apple claims is running an unconstitutional investigation into the company’s business practices.
Apple complained that Bromwich, who has no experience in antitrust law, has already billed Apple over $130,000 to investigate the company, and that he has made premature demands to meet with everyone from lead designer Jony Ive to former U.S. Vice President Al Gore, who sits on Apple’s board. The government countered that Apple does not want to comply with the law.
In hearing arguments from Apple and the Justice Department, the judges expressed skepticism for both sides’ positions, and hinted they may issue an order to spell out the duties of the monitor. More broadly, the fight over the monitor is the latest twist in Apple’s ongoing effort…

Probably a good thing because nobody was going to buy it anyway: Sony (s SNE) is not going to sell its new e-reader, the PRS-T3 released earlier this month, in the United States.
The company cited “the region’s market changes” — i.e., competition from Amazon (s AMZN), Barnes & Noble (s BKS) and Kobo — as the reason it won’t launch here. Sony’s e-reader market share in the U.S. has dwindled to negligible levels in recent years.
Here’s Sony’s rationale, in a statement via The Digital Reader:
“Sony will not be offering the Reader PRS-T3 in the United States. In response to the region’s market changes, Sony will be focusing instead on mobile and tablet devices, including the Xperia Tablet Z and Xperia Z smartphone. Obama is giving a jobs speech Tuesday at Amazon’s(s amzn) warehouse in Chattanooga, Tenn. — infuriating booksellers and publishers, who see this as evidence that the Obama administration is in the tank for Amazon (especially following the Department of Justice’s win over Apple in the ebook pricing case).
“No American monopoly has ever been so cozy with the government,” Dennis Johnson, the founder of independent publisher Melville House, wrote on his company’s blog.
Book trade publication Shelf Awareness cites angry letters from the publishing industry. In one, sales rep Bruce Joshua Miller cites Amazon’s alleged mistreatment of workers at a Pennsylvania warehouse with no air conditioning and writes, “This visit comes at a time when Amazon, despite losing money in the most recent quarter, is attempting to further damage brick-and-mortar stores by lowering discounts to unprecedented levels.”
